VROOM Terms of Use

1. Purpose and publisher

These terms govern the use of VROOM, the app for iPhone and Android and the online game at leconducteurmalin.fr/vroom (the “service”). VROOM is published by Florian Peyrot, sole trader (French micro-entreprise) trading as Le Conducteur Malin, 14 rue Waldeck-Rousseau, 69520 Grigny-sur-Rhône, France, SIREN 130 886 013, RCS Lyon. Contact: contact@leconducteurmalin.fr.

By using VROOM, you accept these terms. The VROOM privacy policy is part of them.

These terms are available in French and English. The app is offered in six languages (French, English, Spanish, German, Italian, Portuguese); if the French and English versions of these terms differ, the French version prevails.

2. The service

VROOM offers short lessons and games about the rules of the road, car mechanics, car history, motorsport and car brands. It is free to play, with no account. Fuel limits the number of exercises per day; it refills every morning and can be earned back by playing or, if you wish, by watching an ad. The VROOM+ subscription is optional.

3. Educational content, not an official test

• VROOM helps you revise. It does not replace the official driving theory test of any country, training at a driving school, or reading the official texts. Doing well in VROOM does not guarantee passing the test. VROOM is not affiliated with any government agency or testing body.
• Each “road rules” track covers the rules of one specific country, chosen in the app out of ten (France, Belgium, Switzerland, Quebec, United Kingdom, Spain, Germany, Italy, Portugal, Brazil) and written in that country’s language. It is carefully written from the regulations and provided for information only: rules change and every country has its own. If in doubt, the official regulations of the country concerned prevail.
• Mechanics tips are general. They do not replace your vehicle’s manual or the advice of a professional. If you have any doubt about your safety, stop and call a professional.
• Never play while driving.

4. Rules of the game

• Kilometers, bolts, fuel, spare wheels and other game items have no monetary value. They are not sold individually, cannot be traded, converted into money or refunded. Some VROOM+ benefits provide them (for example unlimited fuel). They may be adjusted to keep the game balanced.
• League kilometers are earned only by playing: right answers and completed lessons. No purchase or subscription gives any. Until online play opens, your opponents are practice drivers simulated by the app.
• Your progress is saved on your device. Deleting the app or the browser data erases it. The backup code in your Profile lets you copy it to another device.

5. The VROOM+ subscription

VROOM+ adds comfort to the game (for example: unlimited fuel, no ads, extra sessions). The exact list of benefits and the available plans (monthly, yearly, and family yearly with Apple Family Sharing) are shown on the app’s offer screen before any purchase, with their price in your store’s currency.

• Payment: the price is charged to your Apple (App Store) or Google (Google Play) account when you confirm the purchase.
• Automatic renewal: the subscription renews for the same duration and at the same price unless you cancel it at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before the end of the period.
• Cancellation: at any time, in your store settings (iPhone: Settings, your name, Subscriptions; Android: Google Play, Payments & subscriptions). Direct links: App Store, Google Play. Benefits remain active until the end of the paid period. Deleting the app does not cancel the subscription.
• Free trial: when a plan offers one, its length is shown before purchase. It is granted only once, according to the store’s rules. If you do not cancel at least 24 hours before the end of the trial, the subscription starts and the price is charged. Any unused part of the trial is forfeited if you subscribe to another plan.
• VROOM+ free for new players: during the first days, VROOM+ may be offered without payment, without any payment method and without commitment. This period ends on its own, with no charge.
• Price changes: Apple or Google informs you before they apply, according to their rules; an increase does not apply without your consent where the store requires it.
• Restore: “Restore purchases”, on the offer screen, finds your subscription on a new device linked to the same Apple or Google account.

VROOM+ cannot be bought on the web version: the subscription is taken in the iPhone or Android app.

6. Refunds and right of withdrawal

The purchase is made through Apple or Google, which handle payment, billing and refunds under their own terms, including the right of withdrawal where it applies. To request a refund: reportaproblem.apple.com (App Store) or Google Play Help. We cannot refund a store purchase ourselves, but we are happy to help: write to us.

7. Rewarded ads

Without a subscription, you may choose to watch an ad to earn fuel, within the limit shown in the app (three per day at most). The reward is given when the ad has played to the end. No ad is ever forced on you, and none is shown to VROOM+ subscribers. If no ad is available, no reward is due.

8. Fair use

You must not:

• modify the app, bypass its limits or tamper with its save data to cheat;
• choose an offensive or discriminatory nickname, or one that infringes the rights of others;
• extract the content of the service by automated means, or reproduce it without permission.

9. Intellectual property

VROOM’s texts, questions, the Titine mascot, illustrations and sounds are protected by copyright. The car brands mentioned belong to their owners; VROOM is not affiliated with any of them and describes their logos in words, without reproducing them.

10. Apple and Google

These terms are concluded between you and the publisher, not with Apple or Google. Apple and Google are not responsible for VROOM or its content, and have no obligation to provide maintenance or support for it. On the App Store, Apple’s Standard License Agreement (“EULA”) also applies; on Google Play, the Google Play Terms of Service.

11. Availability and liability

We do our best to keep VROOM available and accurate, but cannot guarantee it at all times (updates, incidents, errors). Content may change: lessons may be added, corrected or removed. Nothing in these terms limits the rights the law gives you as a consumer, in particular the legal guarantee of conformity for digital content.

12. Changes

These terms may change. You will be notified in the app of any significant change before it takes effect.

13. Contact, complaints and governing law

A question, a bug, a mistake in a lesson? Write to contact@leconducteurmalin.fr: we read every message.

Complaints: contact@leconducteurmalin.fr, or by post to Florian Peyrot, 14 rue Waldeck-Rousseau, 69520 Grigny-sur-Rhône, France. We reply within 15 days. If you are not satisfied with our answer, or have had none within that time, you may refer the matter free of charge to the consumer mediator the publisher has joined: CM2C (Centre de la médiation de la consommation de conciliateurs de justice), 49 rue de Ponthieu, 75008 Paris, France, online at cm2c.net. The mediator can only be contacted after a written complaint to the publisher, and within one year of that complaint.

These terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory rules of that country. See also the site’s legal notice (in French).
